Terms of Service

1. Introduction & Nature of the Service

Welcome to Gift·it CARD ("Gift·it", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our web platform. By using Gift·it, creating a fund, or chipping in, you agree to be bound by these Terms.

Important Clarification: Gift·it is a software technology platform designed to facilitate collective group gifting, greeting card presentation, and fund pooling. Gift·it is not an Authorized Deposit-Taking Institution (ADI) or bank under Australian law. Funds collected are held in escrow via regulated payment infrastructure (Stripe Australia Pty Ltd) until withdrawn by the authorized campaign organizer.

2. Eligibility & Account Responsibility

• You must be at least 18 years of age (or have parent/guardian consent) to create an account and initiate payouts.
• You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

3. Group Funds & Contributions

• Voluntary Gifting: All contributions made by givers are voluntary personal gifts to the recipient or campaign organizer.
• Card Keepsake Messages: Contributors agree not to submit offensive, defamatory, harassing, or illegal text, images, or videos. Gift·it reserves the right to remove inappropriate content without notice.
• Refunds: Once funds are pooled and disbursed, contributions cannot be refunded unless required under the Australian Consumer Law (ACL) or by Stripe dispute resolution procedures.

4. Payouts & Withdrawals

• Campaign organizers can request withdrawals of available celebration balances to an Australian bank account via PayID or BSB and Account Number.
• Organizers must ensure banking details entered are accurate. Gift·it is not responsible for funds sent to incorrect accounts provided by the user.
• Anti-Money Laundering (AML) & Fraud: We reserve the right to verify identities and temporarily hold payouts if suspicious or fraudulent activity is detected.

5. Intellectual Property

The Gift·it name, "Gift·it CARD", the official Gift Box Outline Logo, website design, illustrations, and software code are the intellectual property of Gift·it Australia and are protected by Australian copyright, trademark, and design laws. You may not copy, reproduce, modify, or distribute our proprietary assets without prior written consent.

6. Limitation of Liability

To the maximum extent permitted by the Australian Consumer Law, Gift·it is provided "as is" and "as available". We do not warrant that the service will be uninterrupted or error-free. We shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform.
